Welcome to Caily AI. These Terms and Conditions ("Terms") govern your use of the Caily AI voice assistant service, website, and related features (collectively, the "Service"). By using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Description of Service

Caily AI is a voice-based AI assistant designed to help seniors with everyday tasks, promote independence, and keep their families informed. The Service is accessible by phone, web browser, and related applications. Caily AI provides conversational assistance, shopping list management, weather information, reminders, and other features as they become available.

2. Eligibility

You must be at least 18 years old to create an account or enroll another person in the Service. If you are enrolling a senior family member, you represent that you have their consent to do so.

3. Account Registration

To use certain features of the Service, you or a family member may need to create an account and provide accurate personal information, including name and phone number. You are responsible for maintaining the confidentiality of your account and for all activities that occur under it.

4. Consent to SMS Text Messages

By using the Caily AI Service, you acknowledge and agree that:

• Caily AI may send SMS text messages to the phone number associated with your account only when you explicitly request it during a call or interaction (for example, asking Caily to text you your shopping list).
• Text messages are sent on-demand at your request and are not automated marketing messages.
• Standard messaging and data rates from your wireless carrier may apply.
• You may stop receiving text messages at any time by simply not requesting them. If you wish to revoke consent entirely, contact us at info@caily.ai.
• Message frequency varies based on your usage and requests.
• We use Twilio as our messaging provider. Messages are sent from a Caily AI phone number.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for any illegal or unauthorized purpose.
• Attempt to interfere with, compromise, or disrupt the Service.
• Impersonate any person or entity in communications with Caily AI.
• Use the Service as a substitute for professional medical, legal, or emergency services.

6. AI Limitations

Caily AI is an artificial intelligence assistant and has inherent limitations. You acknowledge that:

• Caily AI is not a medical professional, therapist, or emergency service. In case of emergency, call 911.
• Responses generated by Caily AI may not always be accurate, complete, or appropriate.
• Caily AI should not be relied upon as the sole source of important information or decision-making.
• The Service may experience downtime, errors, or interruptions.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the practices described in the Privacy Policy.

8. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are the property of Caily AI and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may stop using the Service at any time. Upon termination, you may request deletion of your data by contacting us at info@caily.ai.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any information provided by Caily AI will be accurate or reliable.

11. Limitation of Liability

To the fullest extent permitted by law, Caily AI and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website with a new effective date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions.
